This year, we are watching the ethical
implications of the Michael Cohen affair, the
extraordinary disclosure that he personally paid Stormy
Daniels for her nondisclosure agreement for the benefit of
his client, President Trump, but apparently without the
president's knowledge or consent; the ethical implications
of the FBI raiding his office and seizing client files; the
“new facts” (per new Trump counsel Giuliani) that Trump was
aware of the payments; etc. More generally, Mr.
Cohen's situation raises interesting ethical questions about
the role of “the lawyer as fixer”.
