Real Estate Issues at the Forefront During COVID
Covering the current issues facing real estate
attorneys in the pandemic time – including issues of default, construction,
eviction moratorium, title closing and notarization – plus latest developments
in PPP loans, force majeure clauses and insurance overage issues. The

This will be an overview of important issues impacting real estate
practitioners as a result of COVID-19, including Payment Protection Plan
and other SBA programs, COVID-19 and potential insurance coverage, and
force majeure and other contract defenses.

LOAN ISSUES – lllen J. Dickey, Dallas, Texas
The continuing economic stoppage prompted by the spread of the COVID-19
virus is likely to trigger both monetary and covenant defaults of
countless obligors under CMBS, bridge, construction, and agency loans
over the next several months. All property types, from hotels to retail
to student housing and multifamily are affected – many lenders and servicers are
now interested in restructuring
defaulted or soon-to-be-defaulted loans. A well-structured forbearance
may be the best option, providing added legal protections
to the lender. This session will examine forbearance, and why
foreclosure proceedings may not be practical.

The presentation will cover the primary construction issues that arise
due to COVID-19, including delay claims and project site protocol. The
presentation will also address the revisions that parties should
consider when entering into contracts during COVID-19.

For transactions closing right now, getting documents notarized and
recorded is challenging. Minnesota has adopted e-notarization and
beginning in 2019 adopted “remote online notarizations”. Learn how these
techniques and other workarounds can help close your deals now.
