Understanding the history of family separation policies perpetrated
against Native American families and the impacts of
intergenerational trauma in the American Indian community is
essential to construing and interpreting the Indian Child
Welfare Act (ICWA).

Nichols, which examines the effect of unjust removal
policies on Sandy WhiteHawk and other families. Following
the film, Judge Stephen Smith and Forrest
Tahdooahnippah engage in a discussion about
Brackeen v. Haaland, the landmark case brought by Texas,
Louisiana, Indiana, and individual plaintiffs alleging ICWA
is unconstitutional that is set to be heard by the U.S.
Supreme Court in its October 2022-23 term, and the future of
Indian law.
